Yea, that is why we pay for "uninsured motorist coverage", however as part of you letting your insurance pay for it they will likely go after him to get the $ back on your behalf.

The good is that you have the car owners name. It may take awhile to get paid. In Calif your insurance will send a letter to the vehicle owner requesting insurance info. IF they do not get a reply within 30 days they will pay the claim under your uninsured vehicle coverage. So it depends on your state

Let me get this straight
First of all let me say, I'm glad you're okay and that the damage to your bike was minimal. But this situation just seems crazy to me. This guy nearly kills you. A witness sees what happens phones the police and gives them a description of the vehicle and a plate number. The police fill out a report and have the name and address of the vehicle owner. And it's going to take them months to get around to doing anything about it?!?. That is bull****. Do you know any cops personally that might be able to help you out? I would be calling them complaining every day, demanding that they go and arrest that *******. And if they still won't do anything, I might be inclined to pay that guy a visit myself.
It's things like this that **** me off to no end.

All I can say is...patience. Look at this way, you have strong evidence that God was looking out for you.
With what you described and the pic, an inch more in your direction and at best you would be laying in a hospital bed someplace ...or a fridge.
Yeah, you have to wait to get justice/$$ from this clown, but every breath you have taken since this happened is a gift. You must be here for a reason.

So glad to hear you survived the "mishap" unscathed.I too
live in the Atlanta area and this is precicly why I DO NOT ride one the freeways.Here, at that time of night, the chances are the car was stolen or like others have said he was inebriated.
I see whý this site has a prayer board. I am not religous so I have other thoughts about the guy I won't mention here. Just say I wouldn't be that nice.

PS 42 miles aint right. I got a buddy rides 72 from Rockmart to Alpharetta every day on a Yamadog.

Thanks again everyone. I do agree it is crap that nothing will ever happen to this person. Well, at some point in their life it will, if you get my drift. I have called the police, the DA and a lawyer. All of said pretty much the same thing.
Can_O_Tuna - Every breath HAS been a gift. I look at things differently now. I know nothing happened to me for a reason and until the day I die, I will cherish it! One inch closer and things would be very different. So, I smile everyday now. I laugh and joke with people. I look at my kids in a different way. And it is all good!!!
