"Malice Murder" ??

    "Malice Murder" ??

    I had never heard of this "charge" until now.
    "Malice" is something I always thought to be automatically present when one person deliberately kills another...Up here it would simply be called First Degree Murder.because it was planned in advance, and I had long thought USA had about the same terminology, so what does it mean and why is there a separate charge called "Malice Murder" ?

    A man accused of shooting and killing his husband was arrested trying to board a flight out of Atlanta, Georgia, authorities said.

    Richard Lee, 40, was arrested April 11 at the Atlanta airport and charged with murder in the death of Michael Roshell, according to the Clayton County Police Department.

    A week earlier, officers responded to a report of an attempted break-in at a home in Riverdale, police wrote in a news release. Investigators said Lee showed up to the house on April 4 and shot Roshell, killing him.

    Further investigation revealed that Lee and Roshell were married.

    On April 10, authorities obtained warrants to arrest Lee on a charge of malice murder, police said. He was captured at Hartsfield-Jackson Atlanta International Airport the following day.

    Additional information wasn’t immediately available, including where Lee was headed.

    Riverdale is about 15 miles south of downtown Atlanta.

    Maybe malice is just a term that precinct throws in for texture??

          Don't you just love it when a person in a foreign country takes more interest in clarifying a quirk of your native tongue than you do?

          Well Georgia IS in the south after all and I suppose they needed a way to distinguish a murder that sprung from anger than one that was borne from love! "This is gonna hurt me more than it's gonna hurt you!"

            Thanks, guys.

            I guess I was mistaken about how your laws work.

            Both of our countries have a legal system based on British law, so I thought murder was always a federal offence, as it is in Canada. and so it would be the same in every State.

              However, in Georgia, killing your friends or anyone you like is free, and there will be no charges. LOL

                You know you're in trouble when the judge has to remove his shoes to tally up all the years you're going to be sentenced to.
