I believ the DOT requires Dual range headlamps. But you could just swap them out for inspection...

If you don't have inspections, then it's up to the cops. In most jurisdictions, the cops don't worry about it unless your light is set up in some obnoxious or ineffective way. But in some places, minor equipment violations like this are seen and abused as a good excuse to stop and shake down bikers.
What do the Hardley-Ableson/chopper/streetfighter guys in your area do?
Here in Indiana, there are no inspections and repurposed fog lights are pretty common on choppers and streetfighters, and no one seems to get bothered too much.
I might also note that a clean, high-quality installation will help fend off potentially expensive questions. If a surplus fog light is taped and bungee-corded to your forks, it's pretty obvious that you're sliding by.
