That depends on your definition of "bad".
It's bad on the engine (changes jetting requirements)
    It's bad for noise pollution
    It's bad on your ears
It's bad publicity for responsible motorcyclists

What broke? The hanger on the pipe or the mount on the frame? You can hold up the muffler with baling wire or a large hose clamp wo you don't lose it.

"Legal" is up to the authorities in your area. You might get away with no tickets, but the carbs still need to be re-jetted, you will still be upsetting people all around you, you will still be losing your own hearing.

Get a modern day bike. Unless you have some SERIOUS fabrication skills, and are willing to change the frame a bit, it will never fit.
Besides, if you had those kinds of skills, you wouldn't be asking how to salvage a broken mount on your muffler.

I am under the impression that EVERY state has laws of some kind, regarding the presence of noise-cancelling devices on vehicles.

The question is ... how strictly to they enforce them, and how lucky do you feel?

Why don't you contact the DMV for Texas or spend some Google time researching Texas laws?

ok their is no muffler noise regulations but it says i must have a muffler that passes emissions tests

so i made a new bracket cut a 2 inch piece of steel and then drilled 2 holes and bolted it on
