Rusty Rider new fork seals, retaining spring won't fit w/ flat washer, leave it out ?

    Rusty Rider new fork seals, retaining spring won't fit w/ flat washer, leave it out ?

    Seal is bottomed out, seems these seals are .005 - .010" taller (thicker) than what came out.
    There is a flat aluminum washer between the seal and the funky spring /circlip that holds the seal in place. Some bike don't have that washer, mine does. Or did.
    Can I just leave the washer out and put my forks together and ride the @#$%^ bike ???

    The parts diagram doesn't show the washer, I'm proceeding without it
