thanks for the response tkent. One less worry for me. I had ridden the bike about 2500 miles since the repair and got worried by this thread...

Hi Mr. Drbarson,
You'll find lots of shafty lovin' on my little website (remember your "mega-welcome"?). There are articles about changing the gear oil (sometimes called bezel gears, or secondary gears) and final drive unit oil. There is also a seal at the back of the gearbox where it meets the drive shaft that has been known to fail occasionally. You can remove the boot and inspect. Keep us informed.

update!
thanks again everybody so far,
turns out that my bike at one stage has had a 850 hub put on it.
also the oil comming from the rubber boot is actually comming from the rubber boot, turns out the hub has blown its seals and oils is running down the tube and out of the boot.
That red oil i originally spoke of was actually grease, turns out someone took the rear wheel off and coated the inside of the hub with grease and as the temps got hot it flung it out all over the wheel... He said this could of been done to mask a orignal oil leak from this area as the grease acts like a seal and soaks up some of the oil.
He qoated me 500$ for a seal kit or, 300$ for a 1100g hub he has in stock ( second hand and ausi prices) so i went for the hub.

You could buy a rear differential here in the states and have it posted to you for a 'whole lot' less than $300 AUD!
a used third member (hub as you say??) shouldn't be more than $25~50. then guessing another $50 to ship it
