Thank you guys, I do feel very lucky. Yesterday and today I am very very sore on my left shoulder. Looking at my jacket and helmet, I'm pretty sure I landed on my shoulder. I can't lift it at all due to deep bruising. I rather have this than a broken bone or worse...

A suggestion from one who has hit the ground once or twice over the years - get to a drugstore (chemist/pharmacy) or natural health type place and get yourself some 'Arnica' cream. Slather on liberally anywhere that's bruised and DOESN'T have any broken skin.
If you and your mate have any grazes, then get some Aloe Vera, either direct from an aloe plant, or from the same place (usually gel in a tube) that you got the Arnica from, and use the gel squeezed out of the aloe leaves (or tube) directly on the grazes. It'll soften the scabs (which helps prevent them cracking), and speed up the healing process heaps! And it feels REALLY good on itchy healing new skin!
DON'T use Aloe on any deep wounds - as it heals things too quickly, and closes the top over and stops the wounds from draining properly, which can cause problems.
Note: All above remedies have been personally tested by myself (recently) - and worked for me. YMMV.
PS - Aloe vera also works well on itchy rashes like excema - on humans, and I've used it on my dogs as well!'07 Yamaha TTR 250 - Exercycle.

I Skyboy, sorry to hear about your incident. I can't help with parts for the bike.
As for that shoulder I am going to suggest that you get down the doctors or hospital or whatever you guy's use and get it checked out.
Reason why, I crashed my bike a few years ago and couldn't lift my arm high enough to get a jacket on. I could lift and work as normal but not get any clothes on. Turned out that I had walked around with a dislocated shoulder for 3 months.

Suzuki Mad,
Thank you for the concern. I can tell you that I am 99% sure that it is just my muscle. It is getting better by the day. If it persists for more than a week, I will get it checked out. I can feel the muscle that is sore, I can move my arm around and the only thing that hurts is the muscle.

I had never heard of Arnica and will have to check that out. Thanks for the tip.
Thank you everyone for your concern. I should be in contact with the insurance adjuster today. Yesterday, he cut my passenger a check for his helmet, jacket, and pain and suffering.

WOAH!
So I just talked to the insurance adjuster. Yesterday he paid my friend for his helmet, jacket, and pain and suffering. I asked him when we are going to look at my stuff and he said that I am not covered and that, infact, I was negligent. I quickly left a phone message for my insurance agent. This sh*t better be resolved soon.
Apparently it was my fault that I couldn't stop for an accident that took place right in front of me. This makes me so mad...

Now you know why they are called, "adjusters".
If you were ot covered and negligent, then why was your passenger compensated? And, if I was your friend I wouldn't be so quick to accept ANY payment right now. You don't know what may crop up or linger for a while.
NEVER, EVER make a remark, even in jest that you were "apparently at fault", even on a message board. These insurance companies are ruthless.
And if they try to total your bike and then allow you to "buy it back", don't fall for it. The bike is still yours, they aren't buying it, nor do they have any right or claim to the title. Insurance covers the loss in value, not the ownership.
You have the right to remain silent. EVERYTHING you say will be misquoted and used against you in a court of law.
As Ron White says, "I had the right to remain silent, but not the ability."

Zook, good advice. Luckily, my father in law (of 3 weeks now) is a lawyer. I think my insurance company is going to be getting a call from him if we cannot fix the situation. I did the math and my claim would be $1300, which is less than what my friend got. I'm sure we can come to an "understanding".

Skyboy, where did your accident happen, I live in the Portland area. Cagers concern the crap out of me around here. I commute to Vernonia from Gresham when I don't have to haul building supplies in my Van. Many times have been forced into another lane or the E strip by cagers with their cel phone in their ear or yacking at their passenger.
My wife had the misfortune of wrecking on my Rebel 450 and went down around 35 mph and broke her left knee. The anatomy of the accident will be posted later.
Glad to hear that you fared well, we should hook up and take a ride some day.

It happened on I-5 and Lombard. We will definitely go for a ride, but it might be a while for me to fix my bike.
I am sorry to hear about your wife. I hope her recovery is swift.

Sky,
I think you'll find that the decision to lay it down is considered a crash in legal circles. Your failure to keep a safe following distance is your negligence.
Your friend got paid because your negligence makes you liable to him for his damages. Hence the check. Liability insurance is required.
IF you have comp or collision on the bike, your policy will pay for the bike damage, less the deductible.
Your motorcycle policy will expressly exclude your gear, which is personal property and covered under your renters or homeowners policy. There is no med pay required in Oregon for motorcycles, and you didn't rack up any medical bills.
I don't mean to sound harsh, because this is just the facts. I don't think your FIL can create coverage where it doesn't exist.
Life is full of lessons. Here's one from your local geezer. Read any insurance policy you ever get in life, and ask questions. Your agent is typically a guy who decided not to sell used cars for a living and knows very little about what he is selling. I don't care how
professional he looks. Someday we'll have a beer and I can tell you stories you wouldn't believe about this.

I'm saddened by this story. Really sucks. Glad you guys weren't hurt worse than you were.
Here is CA, if you rear end someone it's almost universally considered your fault. Doesn't seem to matter much whether or not the guy in front slammed on his brakes or what have you, you are expected to have adequate spacing so you can stop regardless. Not sure if it's too late or what but I wouldn't mention that you laid the bike down to avoid a collision, just tell them you grabbed your brakes and because it was wet, you went down. Makes it more clear cut as to what caused the accident. At any rate, good luck with all that and let us know what happens.Last edited by Nessism; 09-05-2008, 02:48 PM.Ed

Again, thank you all for your words. I have yet to talk with the people I need to at the insurance agency, so no news on that front. The renter's insurance idea was a good one. I am going to look into that.
Now that it has been a week since this happened, I am shocked and amazed that we are in the condition we are. Yes, I wrecked my bike, but I didn't wreck my life, or worse, my friends life. I think I had, and still have, a lot of anger and frustration, though, to the person who cause the accident initially, to myself, and now my insurance company. But now completely knowing the outcome, I feel better about things. In fact, just got back from a weekend of vacation and feel real good. And no doubt all your thoughts and words have helped. I always appreciated this community for their help and wishes.
Thanks again.

Update: The insurance adjuster's supervisor and I talked, he got straight to the point and wanted to work the case. He asked for the copy of the police report I have and wanted to do due diligence, unlike the first adjuster. Hopefully this will be resolved soon. I was certainly comforted by his willingness to look into it further.
